What are we each entitled to in our divorce settlement?

What does the law say about how to split the house, how to share pensions and other assets, and how much maintenance is payable.

What steps can we take to reach a fair agreement?

The four basic steps to reaching an agreement on divorce finances are: disclosure, getting advice, negotiating and implementing a Consent Order.

What is a Consent Order and why do we need one?

A Consent Order is a legally binding document that finalises a divorcing couple's agreement on property, pensions and other assets.

I am not sure what an actuary''s report is going to achieve in relation to the pension. AFAIK there is a simple approach to sharing services pensions - or at least working out entitlement. It is 50% of CETV for the duration of the marriage. The spouse gets a pension in their own right within the scheme so equalisation etc is not an issue.

There are some current issues with MOD pensions, cetvs etc which may complicate things a bit for you. However if you have worked out an offer that allows the children to be housed now - and gives your stbx an income then I should imagine that trading cash now for pension a LONG way in the future is a good bet. offsetting (which is what this is called) is rarely done on a £ for £ basis.

You say you have exchanged questionnaires - but have you had first appointment yet? You only have to answer the questions a judge says you must. Also if there is to be an actuary''s report, that would be ordered by the judge .. and you can oppose this.

Hadenoughnow thank u sooooo much. Well the problem is, we had to adjourn the FDA as stbx
Failed to file form E till day before so decided to adjourn with Directions agreed re date for
questionnaires to be filed and answered etc. However her solicitor is now saying if we don''t
agree to actuary report as it''s a forces pension then he will apply for directions to force me
To agree and I have to pay half, I simply don''t have it, and I don''t see it appropriate re ages
and length of marriage. Also he said as it''s a litigation conduct matter he will request I also
pay their costs!!!

How long have you been accruing your pension and do you have a rough idea of the CETV?

Police pension is different. happyagain''s questions are key. I think you are being fed a bit of a line ... however you can always suggest you go back t the judge for Directions. AFAIK if the judge orders a joint actuarial report, it becomes a court document and carries more weight than a report you have commissioned yourself. If FDA was adjourned than it is at FDA that the matter could be dealt with.

Well it''s 9 years accrued but was only with her for six of those. The thing is the next appt is an fdr as we agreed Directions. CETV is77k I think. I really am worried about court papers turning up on my doorstep in next few days....
