What does the law say about how to split the house, how to share pensions and other assets, and how much maintenance is payable.

What steps can we take to reach a fair agreement?

The four basic steps to reaching an agreement on divorce finances are: disclosure, getting advice, negotiating and implementing a Consent Order.

What is a Consent Order and why do we need one?

A Consent Order is a legally binding document that finalises a divorcing couple's agreement on property, pensions and other assets.

No, but I''d have thought the LSC will decide she is entitled to funding ( in which case you''re no worse off ) or she isn''t ( but that hardly prejudices you, does it ? )

It''s outside your control and you just sit back and see what happens.

Thanks lmm I guess you are right. Just wondered what happens when someones certificate is revoked? I suppose as we are under court timetable it''s irrelevant as she will still have to comply with fdr etc whether she has funding or not.
I don''t suppose a judge would give a hoot if someones certificate has been revoked for misrepresentation anyway would they?

The LSC do have people who investigate applications, they have a duty to make sure the tax payers money is not wasted on dishonest people, if the certificate is withdrawn then she is on her own, and they will try and get the money back paid so far (unless the solicitor has not applied for the dosh from LSC).

The man to talk with is Charles, regardless the process will still proceed, legal aid or not.
