XH has decided to leave the country to go overseas with his job for a year knowing we are waiting for a court date to determine a financial settlement and finalise the divorce.
Question If he refuses to negotiate and settle at first Hearing can the Judge order him to return to the country to attend further hearings???

The process will still proceed even with him out of the country.

He may not be required to attend all hearings - e.g. a directions hearing for example.

But his prescence is required at the key hearings i.e. FDR and Final hearing.

He can in practise delay/postpone hearings by declaring himself sick etc - but eventually i believe it could go ahead without him.
