Hello,

My wife''s solicitor has written to me saying that my wife is willing to try financial mediation as a next step.

Please can I have some advice on this? For example, some of the questions that spring to mind are:

How does it work?
Is the mediator there to help or just be a referee?
How do I go about setting up Mediation, whose responsibility is it?

I am keen to get things moving as I am currently paying the entire mortgage on a house I don''t live in, the only reason I can afford to live is because one of my relatives has let me have a room cheap until this is sorted. I want to be able to get my own place with a bedroom for my son (access is not a problem, I am getting plenty of that).

It is positive that your wife is willing to attend mediation - hopefully you will be able to come to an agreement in mediation and then you can ahve the written up into a Consent Order - and no need to have to go to court to resolve matters.

Hello Waspy

You could also ring up and speak to your local Mediation Service who usually has a Family Mediation Administrator who could answer any questions you may have.

Family Mediators act as an impartial person to help you sort out the issues that you want to resolve. They are trained to be totally impartial, non judgemental and have knowledge of the law, but do not provide legal advice to either of the parties.

In my experience and practice in Family Law, if both parties want to mediate and engage it can work really well and save you lots in legal fees :)

Thanks for the responses. Spoke to someone on the phone yesterday at a local mediation place, they were really helpful.

I will send a letter to my wife proposing the first date for Mediation, I expect it will get shot down in flames but I can but try.
