What are we each entitled to in our divorce settlement?

What does the law say about how to split the house, how to share pensions and other assets, and how much maintenance is payable.

What steps can we take to reach a fair agreement?

The four basic steps to reaching an agreement on divorce finances are: disclosure, getting advice, negotiating and implementing a Consent Order.

What is a Consent Order and why do we need one?

A Consent Order is a legally binding document that finalises a divorcing couple's agreement on property, pensions and other assets.

I know a pre nup isnt reallyleagally binding in the UK, but have heard of a way of legally protecting your assets to a certain extent before a marriage and wondered if anyone could possibly point me in the direction of the correct terminology!!

Thankyou!!

They're not legally binding if the circumstances change during the marriage. (ie: she gave up her work, to have children, to care for kids etc).

If you divorced, the judge would still look at contribution and need from her.

Im actually asking this question for a friend who is getting married ( silly so and so i say but hey) anyway he got divorced about15years ago but never had a CO or financial settlement as was very young.... his fiance wants to protect her assets should his ex wife come after him in the future as was in the news a few weeks back... she is quite wealthy, he is not!
Thanks

Ooh! Dodgy Turf!!! (I hear the alarm bells ringing!)

My best friend was an intelligent wealthy journalist. She married a painter-decorator guy, who moved into her half-million pound home with nothing put his cricket bag and the shellsuit he stood up in!

Once married, an ex-girlfriend of his (not even ex wife) realised he's married well, and got a financial claim from my girlfriends income!

When my friend was diagnosed with Cancer, couldn't work and couldn't make the payments toward a child that isn't even hers, this ex then gave her much grief, and demanded her child added to the Will, as being a beneficiary to the house!
