hi there

i recently got divorced my ex left the property in july 2017 , since that date i have paid the full mortgage and all bills , i have a 15 year old daughter that lives with me and a 22 year old son away at uni , we still class this as our family home but my ex want the house to be sold , what are my legal rights as we want to stay here ?..im am also on benefits its a struggle but we get by as long as we are left alone. what options do i have / ...thanks

The basic answer is that you must be left with enough money so that you can be rehoused.
Secondly if she is still working you can go for child support. (if you are on benefits)

What are your ages, length of marriage, does your ex work? What is the value of the matrimonial home and how much is outstanding on the Mortgage? are there any other assets and any debts?

You say you are in receipt of benefits, is this because of ill health and is this likely to continue in the forseeable future?

Once there is a clear picture of your matrimonial pot, then guidance can be given about a sale.
