What is that in plan English please? Do I have to wait for an invoice from the Petitioner? Do I have to wait until the Decree Absolute is applied for and pay all the costs? I would appreciate some help. Many thanks
It means that you pay the costs but if you can't agree on the amount of those costs the court will carry out an assessment.
Ideally, the solicitor will send you a schedule costs and you can make an offer to settle.
If they refuse they prepare a Bill of Costs (Detailed Assessment) and serve this with a Notice of Commencement of Detailed Assessment of costs. You then have 21 days to pay or send points of dispute to the bill with an open offer of settlement.
Alternatively the solicitor could just jump to the service of the bill and notice which they are entitled to do.
You could wait or you could ask for details of costs. It's up to you.
