My husband now says he cant afford to divorce me.....
ive got advice and it seems a divorce will cost me approx £15k.
I've been told I need an order to get him out the house ( I live in my bedroom, and under domestic abuse team) and I know he won't leave....so it seems that's a couple thousand,then papers to serve him....it seems there's 3 parts to my divorce..
1 court order
2 finances
3 divorce

I was really hoping to sell our house(it's in my name) use equity to clear debts and we move on in life. But I now have £60k inheritance and he wants half.
I only work pt, and was hoping this inheritance would help me when I retire or at least get me back on my feet next few years...
He has a business (our family one) he can make in 2 nights what I do In a month...
I just begrudge paying out all this for the divorce when it's his attitude and drinking causing us to divorce.

The divorce comes first which allows you to then apply for a financial order.

The financial order only becomes effective once the decree [url=Glossary/General/Absolute.html ]absolute[/url] (the document that brings the marriage to an end) is issued.

The inheritance should be taken into account but so also should the value of your spouse's business and his earnings capacity. You case may also be appropriate for a maintenance order.

You should seek legal advice as a competent lawyer could probably open your eyes to some more positive options.

Thank you for replying....the solicitor I've seen says I need to get him out with occupational order etc...then I can put house for sale and proceed from there...i really feel I can't absorb things and feel so over whelmed.
