What are we each entitled to in our divorce settlement?

What does the law say about how to split the house, how to share pensions and other assets, and how much maintenance is payable.

What steps can we take to reach a fair agreement?

The four basic steps to reaching an agreement on divorce finances are: disclosure, getting advice, negotiating and implementing a Consent Order.

What is a Consent Order and why do we need one?

A Consent Order is a legally binding document that finalises a divorcing couple's agreement on property, pensions and other assets.

I don't know what to expect from our final hearing but I am going to make sure I point out to the judge we have an offer on the house of the average up to date value and she is refusing.

Did you buy the property from your parents at market value?

Are there any other assets? I cannot imagine the judge is going to be impressed by her racking up a huge legal bill for such a small pot.

The judge isn't going to care who buys the property. They will only be interested in the settlement being fair. The timing is poor so a quick sale may well be seen as a good thing.

You will need to make an open offer before the hearing. The judge will be able to see this.

If the loans have benefited you both, they should count as joint and be cleared from the equity in sale.

If you need help to prepare for the hearing, you might want to look at some of the services we offer to support litigants in person, . Give the helpline a call or have a look at the services tab.
