What are we each entitled to in our divorce settlement?

What does the law say about how to split the house, how to share pensions and other assets, and how much maintenance is payable.

What steps can we take to reach a fair agreement?

The four basic steps to reaching an agreement on divorce finances are: disclosure, getting advice, negotiating and implementing a Consent Order.

What is a Consent Order and why do we need one?

A Consent Order is a legally binding document that finalises a divorcing couple's agreement on property, pensions and other assets.

Have filled in form E and exhange with the ex.

I have assets in total of £80k. consists of bank accounts and shares
Ex has assest in total of £11k
18 year old going to university
She is not working
I have a saalry of £50K
FMH has no mortage

We have a FDA, which may turn out to be a FDR, on April 12th. So assume the outcome of the FDR is 50:50. If i accept the outcome of FDR how soon after do i have to give her her share?
Am I still allowed to spend the money in my account?
At what point does the court put down a marker? Is it the value at exhange of form E or is it when the Consent Order is approved by the Judge?

The reason I'm asking is that i want to pay all my solcitors bills before the agreed split

How soon after do i have to give her her share?

Typically 56 days after the CO is approved by the courts unless another term is specified in the document.

Am I still allowed to spend the money in my account?

Yes you can spend normal monthly expenditure.

At what point does the court put down a marker? Is it the value at exchange of form E or is it when the Consent Order is approved by the Judge?

I suppose the moment that the terms of the deal become fixed is when the final vsn of the CO is printed and signed along with the accompanying D81 Statement of Information.
It may take several more weeks or months even to be Sealed by the court but the terms won't change whilst it is in the queue to be approved.
