My x2b wiped out our bank account (several thousands of pounds) on the day he left, 3 months ago...
Yes... technically it is not theft...
As the fella at the bank told me... because we had 'either to sign'..I could have done exactly the same thing, if I so wished.
However.... it CAN come into play farther down the line, as my sol told me....
She has asked via my x2b's sol for his guarantee that this money will remain in his new sole account until 'things are settled'.... however... she also told me that because we have additional assets it was not necessary to 'freeze' his account or some such like... because when the financial stuff gets sorted this money will be taken into account, and if seen approriate it can mean that I can be 'awarded' an extra percentage of the assets...

Thanks very much. The problem with my case is that i suspect she is holding the money in an account i dont know about. either in her name or someone elses. does anybody know if texts can be used as evidence as she has sent me some real whoppers that incriminate her in almoast everything she has done

I know in Scots Law texts are not submissable in a court of law. I received loads from my ex threatening me and my family but nothing could be done about it. Sorry that's probably not the answer you were looking for.

Thanks for that . Do u know i dont really give a shit what i come out of this with i just hope and pray my kids dont think im some arsehole who left them for nothing and sold their house for no good reason. I suppose i have a bit of an issue with that being self employed. you see if i chose to i could work 100 or maybe 80 hours per week and keep them where they are. Or maybe even 60 hours would do it. It just doesnt feel right. My wife has known me for 21 years and i think she wanted the house sorted with the second mortgage. She diddnt expect to be caught but when she was she expected me to do whatever it took to keep them in that house in that nice area. I feel guilt because i would expect myself to do it. I question myself constantly. Dont feel i have it in me anymore to work those sort of hours but wonder if i will regret not doing so.
