Do anyone know if a child's disability living allowance is classed an income in a divorce? Also what about the children's savings accounts?

my kids accounts have not been mentioned and i have fdr next week... but not sure re benefits prob come under section of needs and living costs.... looby

thanks for reply. my husband is pushing for a divorce with a 50:50 split without going the courts. He wants to buy me out 50% but the kids will live with me, I suspect he is having an affair as is keen to sort things out quickly.

A child's DLA is NOT classed as your income as it's for the child's needs ,you do NOT put the child's DLA on your form E it is not used in any calculation if you need to claim any benefits for yourself,

Get some legal advice asap. I suspect he knows you are entitled to a 70/30 split which is why he is pushing you for 50/50. Dont sign anything till you get some help.

yes sd correct but you need legal backup if there is to be a Clean Break i.e closure on any financial matters. Its a real headache divorce is the easy bit i reckon
