What are we each entitled to in our divorce settlement?

What does the law say about how to split the house, how to share pensions and other assets, and how much maintenance is payable.

What steps can we take to reach a fair agreement?

The four basic steps to reaching an agreement on divorce finances are: disclosure, getting advice, negotiating and implementing a Consent Order.

What is a Consent Order and why do we need one?

A Consent Order is a legally binding document that finalises a divorcing couple's agreement on property, pensions and other assets.

I'm starting to panic. I've been reading a lot of the threads and there are lots of references made and advice given about not leaving the family home.

I left my home nearly 2 years ago now, and have been struggling to pay rent for myself and 2 children ever since while he is mortgage free in our old home. I've finally received my nisi and am about to file my Form A but am now very worried that I shouldn't have left the house.

I had good reasons for leaving including the fact that the house is on his family farm, next door to his parents and sister's houses and it would have been extremely difficult for me to stay there surrounded by his family.

However, I could do with some thoughts on whether I've lost any chance of every getting my half of the value of the house? My solicitor has not referred to the fact that I left at all.

I wouldn't worry, in many cases it doesn't make a difference and if there are sufficient assets to meet eveyone's needs with a 50:50 split you should be fine.

Thanks Fiona, I trust my sol and I'm sure he would have advised me if he thought it was a problem but I seem to need constant reassurance about every detail these days!

Go easy on the trusting bit.

A friend of mine trusted his sol. It cost him £60,000 of legal fees before he realised that the trust was misplaced!!

Like most ppl a sol will look out for himself before anyone else so watch him/her like a hawk. B)

Dont panic .... i too left FMH with 2 kids for every good reason... despite 2 letters from sol he refused to budge. It has not really affected my bargaining power thus far. Also I trust my solhe has done above and beyond for me and knows whats coming... he even let me wait til all settled to pay him... so all sols not bad
