What are we each entitled to in our divorce settlement?

What does the law say about how to split the house, how to share pensions and other assets, and how much maintenance is payable.

What steps can we take to reach a fair agreement?

The four basic steps to reaching an agreement on divorce finances are: disclosure, getting advice, negotiating and implementing a Consent Order.

What is a Consent Order and why do we need one?

A Consent Order is a legally binding document that finalises a divorcing couple's agreement on property, pensions and other assets.

Hi, any advice on my dilemma plz

Hubby earns 35-40k, im at uni with no income ony student loan and child tax. The mortgage is in joint names, but is very small, only owe 37k, so therefore mortgage payment only 283 pm. Hbby seems to think that it is acceptable to pay just the mortgage and no maintenance, says its one or the other. I cant see this being correct, can ayone else? Reason i say this is because, csa alone would want more than that a mth, plus theres the issue of spouse maintenance, and also, the morgage is joint, therefore he has a responsibility to that, regardless of anything else. Am i correct with this line of thought?

If you haven't already, go to the financial advisors or student support people at your university and ask if they are able to help with either emergency funds or a bridging loan. They should also know if you are eligible for any other funds. Meanwhile, ring the child tax credit people to see if you're entitled to more. Make sure the council tax payments are reduced as there's now only one adult in the house - you can do this at the local council offices.

You may have done all this already, of course.

Good luck!

Yeh ive done those things athene, just everything takes ages, ive been witin on child tax for 4wk now, but i think i should have this soon and they will backdate it.

Uni can lend me money, but have to pay it bk from sep loan, so im holdin off with that for now.

Sorted council tax, as im single, and at uni, im totally exempt.

Think ive done all i can do, but my income is only tax credit and child benefit, which totals 444 pm, my outgoings 1300 pm. Hubby used to give me 500 a week, so cant see me geting that from courts, but hey, who knows.
