so how would it work in my case then when the wife earns £43k an i earn £21k and she wants me to move out? we been togeather 17years(we meet at school)married for 9 and have 2 children of 9 and 10,i have looked into getting a mortgage and can only raise about £80-90k max cant get a house arond here for less than £130k,there is £100k equity in the house, i would like to have joint ress of our children as i dont feel they or i should loose out on our relationship..

Maxx in your case you don't say what the existing mtge is -but I suspect W on £43 can raise funds to buy you out.

What is the pension posn?

Yours approaches a long mrge if Mrd 9 & lived together 8 years -so equality is more likely- if a medium length marriage the s 25 factors Fiona has rightly pointed out will always be considered -priority is housing here -whydont both of you have = hsg needs...may push Court to getting her to riase c 50%

If she cant then she raises what she can and the balance after any adjustment for pensions and looking after children deducted will be a deferred charge on FMH in the form of the Mesher Order...you get the charge £ paid on happening of events. eg when C attain 18 or finish Uni, her death, remarriage or further order of Court etc.
