What are we each entitled to in our divorce settlement?

What does the law say about how to split the house, how to share pensions and other assets, and how much maintenance is payable.

What steps can we take to reach a fair agreement?

The four basic steps to reaching an agreement on divorce finances are: disclosure, getting advice, negotiating and implementing a Consent Order.

What is a Consent Order and why do we need one?

A Consent Order is a legally binding document that finalises a divorcing couple's agreement on property, pensions and other assets.

Hi Sarah,

Thanks for these kind words- we are fighting hard for the house- but what makes it harder is that as well as the Royal bank of scotland he actively wants us out as well. The two eldest kids don't have the ability to understand the situation- but i feel for the 19 year old who is at uni- the dad he adored for 18 years has let him down badly- and he does understand. He wants nothing to do with him- and I don't think that will ever change now.He will miss the wedding and christenings- and graduation- and his first commercial flight (he is training to be a pilot). He is the one that has lost out in the end- I know its been hard- I wouldn't wish the last 2 years on anyone- but I'm really Ok now and can see light at the end of the tunnel xx

Thanks Attila-
No there was no disclosure- neither I or the solicitor/barrister knew until we got the questionaire responses yesterday. He apparently brought the property on Nov 12th but made no mention on the 3rd dec(2nd hearing)
Can we still ask for all these things even through apparently the absolute was granted in July (although I haven't received any paperwork)
I feel quite sick to think that whilst he was standing up in another court and urging the mortgage company to repossess a property that has been adapted for 2 severely disabled children he has secretly brought another house.
Many thanks.

hi Attila,

Can I do all the things you suggested even if the absolute has been granted?
Again many thanks.
