What are we each entitled to in our divorce settlement?

What does the law say about how to split the house, how to share pensions and other assets, and how much maintenance is payable.

What steps can we take to reach a fair agreement?

The four basic steps to reaching an agreement on divorce finances are: disclosure, getting advice, negotiating and implementing a Consent Order.

What is a Consent Order and why do we need one?

A Consent Order is a legally binding document that finalises a divorcing couple's agreement on property, pensions and other assets.

Hi there

and welcome to wiki.

when It comes to form E he will have to disclose all his assets as you will no doubts already know. He will have to give 12 months of statements for every bank/saving account he has or had in the last 12 months. so any account he has closed he will still have to show statements within the last 12 months up to the point of closing it.

so any sums of money that have been shifted from these accounts you will be able to ask about in the "Questionnaire of the Applicant/Respondent" which you will send to the court before the 1st appointment for AR.

In the mean time if i were you i should get all account details if possible and vehicle registrations and approximate dates you believe they ownership was transfered. so that when it comes time you can ask some very direct questions.

hi
my x2b omitted alot from form e i.e 1 major investment account, assets and valuables, insurance etc
he also was using brothers account too
I think he may have got away with it as he is tactically minded... of course we have questioned the same and awaiting final hearing, but from what i have witnessed thus far... i think it appears to be unpunishable to lie and not disclose all funds/assets.... my best thing is to not have a Clean Break order so i will return and bite him in the bum when his guard down
unfortunately its a very unfair process.. in my experience
