Why is it possible for anyone that is divorced to re-apply at a later date for additional financial matters. Surely if they are DIVORCED, then it doesn't count? Is this what a Clean Break Consent Order ensures - but even so, it don't make sense to me!!!

Can someone please explain the Clean Break procedure for me.

Hello the court will allow it if they belive have evidence of financial ommitions or lies even in the original order i have read cases the court has allowed it for reasons such as deprestion drink drug problems ie they were not in a fit state of mind to accept the original order, oh one other thing clean breaks only apply when there are no children,

Ok divorce is the process that legaly ends the contract of marriage. Thats all it does. Finances are seperate.

Clean break means that you cant have any claim on each other at a later date. Thats the good thing about seeing a sol and not doing it alone. They take you thru the minefield that is divorce.

Clean break comes by way of a court order. This is done thru ancilory relief process (the finance part of divorce) or via filling in a clean break form or doing it on line.

This will give you what you desire. Clean break is imposible where children are involved. Solicitors always try and achive a clean break. Thats there job. Chris
