Am about to Petition for divorce after 2 year separation. It's all very amicable and we have already agreed 50:50 split of finances and childcare. We earn the same and have already bought separate properties. We have downloaded the forms and are going to take them to Solicitor. Both of us are happy with all the arrangements so do we need to fill out all the forms about finances or can we just agree it between ourselves? Any help appreciated.

Firstly well done im pleased for you both this is a nice change.

Short answer yes you can

Fill in form d81 three copye each

Have your sol write a Consent Order both sighn it

DJ has a quick look stamps it and your done :)


The money bit starts when you have the nisi and is legal when the nisi is made absolute.

Warning - may all be amicable now but who knows what the future holds.

Whatever you have agreed re:- assets/pension etc, I would strongly recommend that it forms part of a Clean Break order so there can be no further comeback ever !!!

Obviously you cannot involve child maintenance in a clean break.

Thanks everyone. Wasn't expecting such a quick response! We both agree that because it is a complete 50:50 split of everything, including shared residency of children, there will be no comeback later. Dukey, would you know where I can get form d81? We are trying to avoid Sols during the preparation stage, but will consult them further down the line.

Hello again

Find the local civil court (off the net) pop in and ask for a divorce pack its all in there with guides of how to fill them in.

You can get more imfo from the law commision again on the net, there are completed forms you can view, and that helps to.
