What are we each entitled to in our divorce settlement?

What does the law say about how to split the house, how to share pensions and other assets, and how much maintenance is payable.

What steps can we take to reach a fair agreement?

The four basic steps to reaching an agreement on divorce finances are: disclosure, getting advice, negotiating and implementing a Consent Order.

What is a Consent Order and why do we need one?

A Consent Order is a legally binding document that finalises a divorcing couple's agreement on property, pensions and other assets.

Hello All,

My X got legal aid for AR last year, this was revoked in January (NB revoked not ended) this I assume means that the LSC have decided that her financial disclosure was not full and frank. I have asked for an explaination from her sol but as usual I have been ignored. We are post FDR and approaching full hearing in early May. There are other issues I want disclosed that have also been ignored.

Shouls I make another appplication for directions? (ie disclosure)

Many thanks

Hi Mark

Forget it, having her legal aid revoked is not really anything to do with you and they dont have to answer any of your questions as to why. Revoked in legal aid terms means.........they will not continue to pay any more of her bills, and she will have topay back any monies they have given her already. This could be due to many reasons. In our case my husbands ex wifes, legal aid was revoked because we told them she was claiming it fraudentely...they investigated and from what we could gather they never answered any of their questions or filled in the form, so legal aid gave them a deadline to fill in the forms, they never resonded, anyway after a couple of weeks she did answer their questions and she got her legal aid reinstated. (to our frustration!!) When she finally gave disclosure on form E some weeks later, we could finally proove all we had been saying, she had been receiving cash into two separate accounts,(she made a mistake in 12 months accounts, i studied her accounts till i found what i was looking for a £20 payment going from one account to the hidden one!!) although only disclosed one bank account and refused for 18 months to disclose her other account. Legal aid board felt the same way and revoked her monies again, this time not giving her it back at all and charged her 4k plus interest and put a charge on her house for the money at the same time.
The best thing to do is send them a letter stating if you do not get the answers to your (pertinent questions)within 14 days, then you leave me no choice but to ask the courts for a directions hearing. It depends really on what questions you want answered, asking questions on her revoked legal aid is nothing to do with you. If you can be more specific on the questions you want answering then I can be of more help in deciding whether its worth the directions hearing.
p2p me if you like, that way I get a message to my email as I dont come on everyday anymore. But I do like to help out where I can.
Kind regards
Louise:)
