STBX moved out into a flat for six months then moved in with the woman he was having an affair with. I feel that when the financial matters are being sorted, he will claim he is no longer living with her, but moves out just for the period. If the court orders such and such, can this be varied at a later date if he moves back in with her?

If he states on his paperwork he intend to co habit in the future but isnt at present. Dont think there will be much you can do about it.

Are you sure he is living with her, he might still have his own place but staying with OW.

Check for concrete evidence that a Solicitor/Judge can use in your favour - Document every thing. Photograph house ingoing/outgoing, travel to and from work, check for paper trail, photocopy and KEEP! records.
