Hi all

Ive finally had the judgment from my final hearing after waiting over 11 weeks. Now waiting for a date to go back to court for the "Handing Down Hearing". Just a few questions on my mind:

1. Nominal Spousal Maintenance has been order but no amount specifed. Will it just be along the lines of £1 per year or can i expect a bit more....like £150 per month?

2. What is the purpose of this hearing as i understood it that the decision is final, (unless totally unreasonalble/unfair)

3. Do I have to attend and what is the expected time allocation?

4. Is the Consent Order signed on the day of the hearing?

Sorry gone off the subject slightly but just so unsettled with it all

Never heard of a handing down hearing but I can tell you about nominal maintenance.

It will probably be £1 a year, but it is still a maintenance order and could be varied upwards ( well, there''s only one way it can go ) if circumstances justify it.

It is usually awarded when there are dependent children involved, to cover contingencies like the possibility of the mother losing her job.

Oh thats ashame as i was hoping for more!!!!

But you are right in that the youngest lives with me and there is a bar on it until she leaves secondary education (Basically two years times).

So have i still got a Clean Break then?...apart from the nominal maintenance?

Technically, no. Spousal maintenance, even for a nominal figure, prevents it from being a Clean Break.

Sir Mike, the so called handing judgment hearing is just an oral judgment usually read out, some judges do them most don''t.

If its just an oral hearing, do i have to attend?

Would there be concequences for not turning up?
