Can anyone advise me please ....im representing myself in my divorce, my wife has legal aid.my form E was perfect,in fact it took me weeks and a lot of hard work to not miss anything.my wifes form e took about 2 minutes to read and had nothing in it and was a week late.anyway questions i had done a few weeks later were once again in on time and were spot on ...the wifes late again..then an amended questionare turned up on my door step 3 days before the first hearing.fine ok i have nothing to hide.we went to the first hearing and agreed to answer all the questions in 21 days...well a week later low and behold another amended questionnaire with two extra questions on it turned up on my door step. i need to know do i have to answer the questions ? if not will it slow down the FDR?..as the question relate to my business it does take the bank about two weeks to answer any letters....when will i stop gettin amended questionnares?...help please
In my divorce we are both using solicitors however like you, I had my form E in on time and when stbx finally submitted his form e, we raised a questionnaire as did he, which we exchanged and at the first hearing the Judge directed we both answer the questionnaires
I answered his questions and returned them and filed them with the court, stbx was two weeks late answering mine, but had the cheek to ask further questions of my answers to his questionnaire. My solicitor wrote to his and informed them that we would consider his further questions when he provided answers to my questionnaire and reminded him that his answers were two weeks late
When he came up with his answers, we answered his further questions - so in answer to your questions, yes you should answer their further questions but not until they have answered your first ones
Keep doing everything spot on, it will get noticed
The usual procedure is for exchange of Forms E then questionnaires, such as they are required.
At the FDA hearing, the Judge will decide which questions each party has to answer and delete those that do not need to be answered.
If there are additional questions raised after the FDA hearing, these are not authorised by the court. However, it is possible to raise a supplemental questionnaire if further questions arise as a result of the answers to the first questionnaire i.e.
