What are we each entitled to in our divorce settlement?

What does the law say about how to split the house, how to share pensions and other assets, and how much maintenance is payable.

What steps can we take to reach a fair agreement?

The four basic steps to reaching an agreement on divorce finances are: disclosure, getting advice, negotiating and implementing a Consent Order.

What is a Consent Order and why do we need one?

A Consent Order is a legally binding document that finalises a divorcing couple's agreement on property, pensions and other assets.

Do you need help sorting out a fair financial settlement?

Our consultant service offers expert advice and support to help you reach agreement on a fair financial settlement quickly, and for less than a quarter of the cost of using a traditional high street solicitor.

Could I ask if photographic eveidence of stbx car being at OW house at all times of night and every day be taken as proof of living together?

He is wanting to split assets as if he does not co habit and therefore his needs will be greater. They say they don''t live together so she can claim tax credits for her kids. Apparently he is living with her friend.

This is fraud as far as I am aware and I don''t see why I should subsidise this.

Any advise welcome.

Staying overnight at someone else''s house is not proof of co-habitation. Unless that house is his only residence andor he is making a financial contribution to everday household expenditure, then prooving co-habitarion is very difficult.

If he gets wind of these photos you have taken, either yourself or someone has taken them on your behalf, he could claim you are stalking him.

The Tax credits is a separate issue altogether, and I would be careful before you take any further action on what you believe is fraud.

Thanks Ruby.

I do not have any photos as yet I was just wondering how to prove co habitation and it looks as thought his is not possible. So he will get what he shouldn''t get because of lying about his circumstances and shw will be able to claim money she is not entitled to. That seems fair.

Julie - what comes around goes around - leave him to it and just get on with your life.

A lying deceitful person never wins in the end.
