What are we each entitled to in our divorce settlement?

What does the law say about how to split the house, how to share pensions and other assets, and how much maintenance is payable.

What steps can we take to reach a fair agreement?

The four basic steps to reaching an agreement on divorce finances are: disclosure, getting advice, negotiating and implementing a Consent Order.

What is a Consent Order and why do we need one?

A Consent Order is a legally binding document that finalises a divorcing couple's agreement on property, pensions and other assets.

Hi all,

I am really struggling to fill in the Capital section of this form. Do I put in the equity of our jointly owened property as per our mediation agreement i.e. 75%/25%? Also, he keeps the car he drives which is in my name, where is this captured?

Thanks for any help you can give x

Usually the solicitor who writes the order would complete D81, you do have a solicitor?.

You both own 50/50 and then give how it would be divided, well on the new D81 you do anyway.

My solictior has said that it would be cheaper for me to fill in myself but I think he knows that I''ll struggle and will ask for his help which will in turn mean more money! Should I say that I thought this would be included?

Any ideas about the car? I will be paying off the finance outstanding on this which will make up the £20k he wants from me but I cant see where i note this on the form.

Thank you for your reply, much appreciated.

It seems false economy to me, the wiki solicitors charge £139 for the order and to complete D81, dare i ask what its costing you.

The car is a capital asset, i know they have changed the forms so ill have to print a new one off and get back to you for the exact section.
