Can someone please help me as i am a little confused. You may or my not have read some of my previous post but to quickly summise my dad is divorcing my mum and i have agreed to obtain a mortgage on the matrimonial property on my mothers behalf as she has a poor credit history.
We know the Consent Order has now been approved as we have spoken to the court but we are awaiting for it to be sealed and recived via the post. My dads solicitor is pushing for a copy of the land registry TR1 form transfering the deeds from my mother to myself in order to complete a mortgage offer.
It is our understanding that this can not be done until he has lifed the caution (B94-1 Notice of application for home rights notice)on the property. AM i right in my understanding or can we proceed even though this caution is on the house?
