I am in the final stages leading up to my FA. I am self repping and dutifully exchanged my formE at the court and with ex wife''s solicitors within the times stated. Her solicitors were not ready to exchange on time despite and so took my formE and I had to wait over 2 weeks past the deadline before receiving theirs after sending hasteners to them. It was blatantly obvious upon recieving their disclosure that they had used my disclosure as a template for theirs and used information that only I would be privy to to complete certain section ie mortgage and property details ( as house is solely mine) not beginning to mention the amount of undisclosed finances from their client and missing 6 months of statements.
Despite recieving forms late I compiled next set of paperwork and these were sent to the court yesterday as per deadline. I contacted other parties solicitors and they stated that they were not ready to exchange yet again. They aren''t even due to meet with the ex to go through next stage til next week ( way past court deadline) I suspect it is so they can yet again base their forms on mine.
After the previous experience of them using my forms as a template I have stated that I am not willing to exchange this next set with x until they too are ready. Am I wrong in doing this and will it be frowned upon by the courts? Everything is with the courts on time from my side.

Hi furryfish

from my experience the deadlines matter very little: my stbx missed all of hers and in fact didn''t even bother doing most of the paperwork or provide any proof of earnings and benefits etc.

At the Final Hearing none of this was taken into account by the learned judge....

So to avoid letting your stbx use your documentation as templates, make sure that you have your forms/documentation ready for exchange on or at the deadline, inform your stbx or representative that you are ready to exchange and you look forward to hearing from them that they are also ready, but don''t send it to them until they confirm they are ready and then agree on what date you will be sending it to them and they to you. However, make sure that you file a copy of the documentation/forms with the Court within the deadlines, that way the Court has the information within the timelines, the other side know that you are ready to exchange and it is documented, and they don''t get to see yours until they have confirmed that they are similarly ready

Kind regards
