well, mine has gone to court and to stbx. I am not holding my breath about receiving his!! We had a quick text conversation the other day and he said that there was no way he would be able to complete form E in time (due 5/9!!) because I know all the answers to the questions and have all the information I actually left the vast majority of the information at the FMH with him. The only thing that he really had to work at was his company accounts. I asked if he wanted me to phone court to ask for an extension (I don''t know if you can do this anyway). He didn''t answer that question so I haven''t phoned the court. My forms have been sent - one copy to court and one set to him (recorded delivery). I await his form E for me.
What happens if he doesn''t present his paperwork? Presumably the next stage (questionnaire, etc) cannot be done either.
Forgot to add - I am currently self-repping. Everything can move at my pace and I won''t have to wait for solicitors. I have written to the solicitor who actually filed my divorce for me (I got legal aid for that bit) and asked if he can be on "stand-by" to help me further down the line.
Its not uncommon for the exchange to be late, some are even handed it the day of FDA, calling court is fairly pointless, it wont be recorded, you could write to the judge/court to note your questionnaire will be late due to not having form E.
Don`t worry in reality it tend to not make any difference.
Thank you. I''ll drop the court a letter. Being reasonable, I offered to try to change it for him but got no reply so sod him
He is nowhere near ready to exchange, in fact I think he probably hasn''t done anything about the Form at all. I have sent mine in to the court and to him so have keep my side of it. There''s not a lot else I can do. I didn''t know what the Court would do when he doesn''t bother completing paperwork.
