Under the old Family Proceeding Rules 1991 it wasn''t possible for an MPS application to be heard at the end of the FDR and as far as I''m aware this hasn''t changed under the new Family Procedure Rules 2010. It was possible to hear an MPS application at the beginning of the FDR, but a contested hearing immediately before the FDR where the aim is to reach agreement isn''t a great idea.

FDR is mid october, had a letter today stating if i did not agree to proposal then ex sol has instruction from his client to apply for MPS.
Do you think this is just scare tactics?
Any idea how long MPS hearing takes to go before court?

Usually MPS hearings are heard in an hour or less. Whether it is reasonable for your wife (or the solicitor on her behalf) to apply for MPS depends on your wife''s needs and your ability to pay and which part of the country you are in.

Thank you for your reply Fiona, i personally do not think there is a case for MPS as we both earn more or less the same salary and there are no dependant children.
Could you please explain what the relevance of which part of the country i am in is?
