Right what''s a deferred charge then my needs according to the FDR judge r same with her n I am not demanding more I just wanted time to complete my 1 yr Uni but judge agree house sale can''t wait even tho I live with her two children who she is effectively making them homeless

Homelessness for the relatively young is something close to my heart. It is not easy these days for young adults to leave university education and then find a decently paid job, pay off their student loans and be independent.

Those days sadly are gone and it seems to me that in your situation as a mature student and as Charles says that your wife is currently accommodated and managing that it is you and the older two who are being put under enormous emotional and financial pressure as a result of an FDR direction.

Hopefully someone will be able to give an idea how you put together a proposal for a deferred charge without looking like you are atttempting to frustrate proceedings.

What btw is the likely equity that will come out of the sale of the house assuming you get the valuation price of the property?

Also do the children that live with you have any debts which have accrued as a result of their university fees or expenses?

Have you accrued any debts in getting your education and was and is your wife aware that you were going into further education?

You might have put it at the beginning of the post but is she working and does she get benefits?

My stbx has a good job n started her own business she gets normal benefits I guess such as child benefits n tax credits she does not give her own children who live with me a dime they have debts i have debts my credit reference is mud I just hope I finish my course n get on with things equity is 35000.00 but might reduce coz of moving n until its sold. It''s a long journey I am hoping that someone will come along on here n lay the arguments as best as it can be for me to use in FH in view of the situation

Well one thing that would be useful is an up to date assets and liabilities, income and debts schedule for both of you.

I also think need for accommodation for the eldest two is not irrelevent these days especially as they are still in education so details of their debts and their likeliness to be able to find accommodation whilst paying down debt would also be of use I would have thought - at least it will not do any harm.

If you do not list the problems a court can not consider them.

Can I hear from someone who has gone to FH pliz n hear if cost were awarded against or for them even tho they had complied with the judge Directions the court said the hearing will not be cancelled coz its too late n I know I have complied with the FDR directions why we are still going to FH is hard to understand we have just a house to sell nomore
