There are some recommendations i agree with, inheritance for example, so called ring fencing, but and there always is a but it must be considered in the context of the marriage.

If Bill and Edna divorce after three years and Bill inherited 400k the year before should Edna have a claim, no kids same income same pension bla bla bla, well no, the same if Bill inherited the year before they married, perhaps even more reason why Edna should have no claim.

If Bill and Edna were married 20 years and have three kids ages 8-10-12, Edna has a dodgy leg and can`t work, Bill earns 5k net, they rent and have almost nothing it terms of assets, Bills Dad pops his clogs and Bill receives 400k, should this be ring fenced, well no he has a responsibility to his family, wife included.

The idea that some mathematical formula could be used is far from new, the problem is there are far to many variables to consider, the nuclear family does not exist, each is unique.

I do agree that right now range of discretion is just to wide, but if a judge does make a dogs dinner of it there is the appeals procedure, which personally i also feel is flawed, in fact i suggested to one solicitor that they should all have their own pot to p!ss in rather than the communal one they have now.

Spousal maintenance, a subject debated for years on wiki, there are strong arguments on both sides, Baroness Deech basically said why should a man pay for a woman after divorce, and the men do a Malcolm X style fist pump, and the women say i don`t want to rely on him anyway, but and yes another but, when you marry do you not promise to love cherish and honor your spouse until death do you part, ok so these days trendy kids use their own wording, Shazza i think your fat (it means really good) and i dig you, i think ill leave it at that for fear readers will learn i am as about fashionable as a pair of y fronts.

The fact is when you marry you accept responsibility and law determines what should happen if the marriage breaks down, HRH and others have said that before you can marry you should do a course making you aware of the potential cost of marrying, would it matter if it was compulsory?, do you know anyone who married not madly in love, i don`t, when you marry whats hers becomes yours and whats yours becomes hers, if you have children it matters not how long you are married before it falls apart, if your married a long time before it goes wrong the same.

Ill leave it at that for now.
