My husband has set up house with another woman, leaving me in the house with my 2sons. They are 21and16. He is refusing to pay anything towardf the bills,insurances and mortgage!
I can''t afford a solicitor and don''t know what to do?
Should he be paying half? He gives money towards my 16 year old as he is staying on in full time education.
Any advice would be greatly appreciated as I''m at the end of my tether.

There is no reason why he should be paying towards the bills if he isn''t living there.

You need to post more info on ages, incomes, assets etc for someone to say if you are likely to be entitled to spousal maintenance.

Thanks for the quick reply.
I''m earning £20000pa and have a£70000 mortgage in both our names. But am unable to do anything with it until his name comes off of the mortgage.
My aldest son is 21 and is only working part time as he has just finished uni.
My youngest son is 16 and is continuing at school for his a levels.
I/we have no assets other than the house. We bought a kitchen on credit 2 years ago that I am having to pay for and I am also paying the insurance for the 12 year old dog that he has left with me( I love her dearly) this is the dog that he doted on but found it as easy to dump her as he has me.
I''m not looking for the world but just some help.

It''s usual for both parties to pay the bills for their own household. When one party enjoys the sole use of the former matrimonial home it could be said they should pay their share of the mortgage plus the other spouse''s share in lieu of rent for occupying that spouse''s share of the property.

If that leaves you struggling to pay the mortgage you *may* be able to claim maintenance until the divorce and finances are sorted out should your husband be deemed to have the ability to pay after his meeting his own living costs.

If he is paying the correct amount of cm then I am sorry to say dont think he will be expect to pay much in the way of spousal maintenance.

Have you checked to see if your entitled to any benefits as a single parent
