What are we each entitled to in our divorce settlement?

What does the law say about how to split the house, how to share pensions and other assets, and how much maintenance is payable.

What steps can we take to reach a fair agreement?

The four basic steps to reaching an agreement on divorce finances are: disclosure, getting advice, negotiating and implementing a Consent Order.

What is a Consent Order and why do we need one?

A Consent Order is a legally binding document that finalises a divorcing couple's agreement on property, pensions and other assets.

Do you need help sorting out a fair financial settlement?

Our consultant service offers expert advice and support to help you reach agreement on a fair financial settlement quickly, and for less than a quarter of the cost of using a traditional high street solicitor.

I have just spent the last half hour righting up an epic message to have the page refreshed and lost everything I had written. Grrrrrrrrrr

So to cut a long story short. I was the petitioner in divorce and used the Wikivorce fixed fee service and it was filed at West Midlands Divorce Unit.

STBX Has filed for Financial Order and has moved the Court to Crewe.

1 What is the Process for switching courts.

2 How do I now get an order for maintenance pending suit included in as this has been omitted from his form, but it was included in my application for divorce . ( which I understood that this was the start of the financial without having paid the fee).

3 Do I need to file something at the courts myself.

Hope someone can help.

Sorry I can't answer your questions, I thought you had to go to mediation before applying for a financial order unless agreement had been reached, I got lots of information from the link below which might help or you could ring the advice line at Wiki. No help but Crewe Court is nice it's where I had to go.

Thank you Clawed, We went to mediation Two years ago. and the mediator told us to come back when we had all the necessary financial information regarding Pension Ect.

Until April of this year I have been trying to get disclosure from STBX but unfortunately without success.

In April I wrote his solicitor and asked for voluntary disclosure and for Maintenance payments, which his solicitor did not reply to, although the Mediator rang me to see if we could go back to mediation on 9th June and it would cost me £195. I contacted them next day to say that I thought her fee were to much and declined her services . I then wrote to X and his solicitor requesting form E in order that I could seek legal advise as to what would be a fair settlement then be able to mediation again and there again no reply. In August I again request a reply at which I received a letter from the solicitor informing me that he is awaiting the information from his client.

The Courts have been changed without my knowledge The document is signed by the mediator but in my opinion it has not been dated by her. as 24/7/2017.

I really didn't want to go through the courts, I just don't understand why he will not give financial disclosure unless it is going through the courts.

Regards

I can only answer the question about moving courts I'm afraid.

My ex started proceedings in a court over 400 miles from where I live.

I applied using form D11 (there is a fee payable) for a hearing by telephone to change the court. I chose a court halfway between us so we both had to travel but not nearly as far.

When my ex complained to the judge that he didn't want it moved the judge asked if he would contribute to my travel and accommodation costs. Of course he said no so the judge agreed with the change of location.

Thank you Luna,

This is what I do not understand, this is the first thing I know about it, is when the Papers from the court dropped through the door that said the FA is on 23rd January and form E must be filled by 19th of December.
