What are we each entitled to in our divorce settlement?

What does the law say about how to split the house, how to share pensions and other assets, and how much maintenance is payable.

What steps can we take to reach a fair agreement?

The four basic steps to reaching an agreement on divorce finances are: disclosure, getting advice, negotiating and implementing a Consent Order.

What is a Consent Order and why do we need one?

A Consent Order is a legally binding document that finalises a divorcing couple's agreement on property, pensions and other assets.

Hi.

Can someone please help me complete this form A. So many boxes to tick especially on the first page.

What case number do i write in the top left box ?

Nature of application: What boxes do i tick ? to apply / to proceed or to vary ? I do not have any existing orders so presumably i dont tick vary ?

Page 2 : Please tick the relevant box below to indicate whether this application for a financial order includes an application relating to land: Do i tick this box ? My ex bought a house prior to the Decree Nisi and i would like part ownership.

i am only receiving advice from an solicitor so do i still include solicitor details ?

Please help, Thanks !!

My solicitor did mine so I really don't know but from what I have seen, you tick all the boxes for everything possible!
The case number I presume will be the divorce case number.
I would tick apply, as you are applying.
Personally, even though I don't know, if you are doing as much as you can for yourself, then say to send everything to you, and just use solicitor when needed.

I am just about to fill out the new form A myself.
I know there is a guide on the site here on how to complete form A, but it seems to refer to previous or older version as it does not tally up with the form I downloaded from the official court website.

There is quite a detailed guide on Money & Divorce website, but this also refers to a seemingly older version of form A.

On the form I have it asks on page 2 whether the financial order will include an application for 'land' and details about the mortgagees. I assume this means whether there is property involved, but I am not sure, as on page one it also asks whether you are applying for a property adjustment order. So there seems to be a duplication or land just means land with no property on it. I am puzzled by that.

Hello - am in the same boat! There is no official guide on the HMC site, either!!! The older version was much simpler, in my humble opinion! Like you, I assume it refers to property, but how I am meant to know who my stbx has his mortgage with, is anyone's guess!!!! More a Form E question when there is meant to be full disclosure. May I ask did you just put property address down. I think that is all I can do! Any help out there would be greatfully received!

Yup, I ticked 'yes' and just put down the property address and the mortgage details as requested and that was accepted.

I actually wrote 'property at (....relevant full postal address)' followed by the mortgage details
