What are we each entitled to in our divorce settlement?

What does the law say about how to split the house, how to share pensions and other assets, and how much maintenance is payable.

What steps can we take to reach a fair agreement?

The four basic steps to reaching an agreement on divorce finances are: disclosure, getting advice, negotiating and implementing a Consent Order.

What is a Consent Order and why do we need one?

A Consent Order is a legally binding document that finalises a divorcing couple's agreement on property, pensions and other assets.

The note at the top of the Form H:-

(Do not include here costs incurred in respect of other aspects of the case, for example, the divorce or civil partnership
proceedings, children matters, injunctions, etc.)

Also applies to mediation and should not be included on the form.

If you are acting in person, you do not have to complete a Form H. It is only relevant if you have outstanding fees (solicitors who acted for you previously or fees for expert reports) as these should be taken into account as a liability when determining the appropriate settlement.

Thank you Charles. unfortunately I have included the fees for mediation in the costs but not the divorce costs, I just thought that as it was trying resolve the finances it should be included. What would be best way of correcting this please.

Negotiations outside of the mediation are part of the matrimonial finances - just not the process of attending with the mediator and the mediator's fees.

As far as correcting the issue, you can send another version and a covering letter describing your error (it's minor and has no ill-effect) or you can just leave it. Honestly, the part that the Form H has to play in financial remedy proceedings is minute as the costs rarely effect the settlement. It is also optional for litigants in person.
