We have made an offer but this has neither been refused or even acknowledged.
She failed to attend the FDR hence outstanding costs and the Judge ordered it straight to FH. It taken this long because we had to force her to progress the Decree Nisi undernthreat of having hers dismissed “For want prosecution” So the DN was secured on FeB 7 2018 (13 months) S25 statement filed
We are not having a pretrial hearing as far as I know it’s just turn up an hour before the FH (scheduled for 1 day) I have a Solicitor from day 1 (Same)!
Is she self representing? It may be that she has not understood the process.
If you have made an offer that clearly addresses needs first and would be seen as fair then you may want to reiterate it as an Open Offer. This could then be seen by the judge and may help any claim for costs if the final.settlement is close to what was offered.
If she is represented, the lack of any engagement with offers is unusual.
She is represented by a dodgy solicitor she found near Heathrow Airport who deals mainly in immigration cases. He’s a foreign qualified solicitor who doesn’t seem to have any grasp Of family law or protocols. They never respond to anything my solicitor sends. All information has to gained by court order and even then most of the orders are simply ignored. Hence we have an enforcement hearing on May 10 to enforce disclosure orders and a costs orders from a hearing on Dec 7 2017. She is now claiming the FMH is a 3 bedroomed house although it was built as a 4 bedroomed house, it’s was 4 bedroomed house when we bought it, every other house in the street of the same design is 4 bedroomed and it was valued as a 4 bed early last year.. so a joint funded independent valuer is being asked for.
Open offers have been sent to them in a number of occasions that seek to get me housed nothing more because that’s all I’m seeking. None of these offers have been refused or countered ... They have not even been acknowledged in any shape or form.
My question is how will this been seen by the Judge as on past conduct they will not be making any kind of offer at the final
