My stb x has put in a Form A and the Notice of First Appointment was issued by the court on 10th October. I have today - 29th October - received service of Form A via his solicitor and it says the date set for exchange of form E is the 28th November. But should I not have more time than this - it seems stb x has failed to serve the Notice on me within the 4 days from when he received it from court. So I have less time and have to rush around to meet that deadline. Can I do anything about it?

You should have received the notice for first appointment hearing and date for exchanging form E from the court yourself.

form E is exchanged before the first appointment.

I received date for exchanging form E 6 weeks after sending form A to court.

form E really isn't as bad as it look however it is very long and has various sections.

Applicants can indicate on Form A that they wish to serve the Notice of First Appointment themselves. The rules say that they should do this with 4 days of receiving it themselves. My stbx has not done this. I am wondering if there is any way I can ask for more time?

How likely is the otherside going to be ready to exchange their form E?

From my experience I don't think you can do anything. Just complete the form E and let the other side know you are working on it and will exchange as soon as its ready. As long as its before the first appointment hearing and you have both looked at each others form e and raised your questions it's OK

My ex solicitor exchanged form E with me less than a week before first hearing even though I was ready to exchange by deadline set by courts. I think they done this deliberately so I didn't have time to raise a questionnaire. Luckily for him I still did it and we are at the 2nd fdr stage and he still hasn't answered my questions regarding missing bank statements. Makes me think that he has something to hide.

My advice just make a start and don't worry about deadline. If you need help use this website it's very helpful. I did it all myself and represented myself at hearing.
