The four basic steps to reaching an agreement on divorce finances are: disclosure, getting advice, negotiating and implementing a Consent Order.

Completing the form D81 and there are no problems except for one matter. My grandfather set up a Discretionary Trust in the 1990's and I am included as one of the 'potential beneficiaries'. The Trust to date has not paid out either income or capital to anyone so I have, neither before or during marriage received any benefit from it. Does the trust have to be included somewhere on form D81 and at what value?

I would say it has no current value.

Is your ex aware of it? You do need to ensure it has been disclosed before final agreement is made.

Yes, I have fully disclosed the existence of the Discretionary Trust and the fact that i am one of the potential beneficiaries.
One further question. I have agreed to pay my wife the sum of £80K . Should I include that in the liabilities section of form D81?
