I signed a Consent order that was sealed on 5 March 2020. My decree absolute came though on 3 Jun 2020. I had a family business with my wife up until November 2019 when I was forced to resign as a director and employee as a condition of a Heads of Agreement (which was the basis for the consent order) I signed on the 25 October 2019. MY ex-wife was the revenue generator with client contact and repeatedly told me throughout 2019 that the company was doing very badly and would barely grow in 2019 (she had already told the jointly appointed expert valuing the business that growth in 2019 would be 0% so that the valuation would be low and I’d get next to nothing for my shares). However, our company bank kept sending me brief weekly texts to show the incomings and outgoings that week. I mostly ignored them until I saw that my ex-wife had transferred £100,000 between the time that the consent order was sealed on 5 March 2020 and the end of the tax year 2020. I suspected fraud, prepared a case, and submitted a D11 requesting that the Consent 0rder be set aside on the basis of material non-disclosure of full and frank updating. We had a directions hearing on the 18 August 2020 and my wife tried to get the application struck out. But she failed and it is going to a full hearing. But my question is this: for a number of reasons I’ve decided that I want to withdraw my D11. I recently lost my new relationship because of the stress of the ongoing court cases. It is also now affecting my relationship with my two sons. I know she has committed fraud but to me the other things are more important now that money. How can I pull out easily? Can the other side stop me now, or the court stop me?[/color]
