What steps can we take to reach a fair agreement?

The four basic steps to reaching an agreement on divorce finances are: disclosure, getting advice, negotiating and implementing a Consent Order.

What is a Consent Order and why do we need one?

A Consent Order is a legally binding document that finalises a divorcing couple's agreement on property, pensions and other assets.

The “Schedule of Documents to accompany form E” on page 27 of “Financial statement” “Form E” says “The following list shows the documents you must attach to your Form E if applicable.” For each document, the options to choose between are “Attached”, “Not applicable” and “To follow”.

If a document is “To follow”, when should it follow:
as soon as one receives the document;
at the same time as one files a “statement of issues”, “chronology”, “questionnaire” and “Form G”; or
only when specifically asked to do so?

They should be provided as soon as they are available. Anything that is missing from the disclosure should be mentioned in the questionnaire. This will provide a second deadline for production in the FDA order. You can note that you reserve the right to ask further questions arising from the documents when they are produced.
