What are we each entitled to in our divorce settlement?

What does the law say about how to split the house, how to share pensions and other assets, and how much maintenance is payable.

What steps can we take to reach a fair agreement?

The four basic steps to reaching an agreement on divorce finances are: disclosure, getting advice, negotiating and implementing a Consent Order.

What is a Consent Order and why do we need one?

A Consent Order is a legally binding document that finalises a divorcing couple's agreement on property, pensions and other assets.

My STBX has just made me an offer one week prior to FH. After some hetic discussions, I have agreed in principle to the offer.
He has offered me Life Maitenance ( I am 53, he 59) which because of my mental health issues he wants reviewed at 18mths.
I would like the payments to be index linked but he is totally refusing this because we live in different financial juristictions. I really do not know whether to push this. I have been advised to get insurance to protect maitenance ( I would pay preniums) but to get a quote he has to sign quote form re his general health (which is good) He is making me do a trade off between the 2 issues, but I have to protect myself for the future.

Does anybody have experience about either issues ??
Any contribution would be welcomed, as I feel totally overloaded at the moment.

Thanks in advance....

I believe that spousal maintence can and should be index linked. I am going for this myself which is one of the reasons we are going to court.

What do you mean about different financial jurisdictions?

I also want to do life insurance to protect the maintenance and I will pay the premiums. However, after requesting x to fill in health questions which he said he would do, I have heard nothing since.

What does your solicitor say about all this?

I insisted on having my maintenance index linked; I think you would be wise to insist on this...

Hi
STBX lives in Channel Islands where cost of living is lot higher than here, I live in England, but if order is made here can't see what problem is, we married under English law thank God! The Channel Islands are in the dark ages as regards entitlements to wives etc. may I PM you about Insurance please?
Thanks
Rebus

You certainly may Rebus. I've been busy trying to find a web site that put me on to the idea in the first place but no luck so far.

Hi

Stand firm, the judge will order both. Hopefully between now and the hearing he will listen to some legal advice and concede, but if not, given the importance of both these issues, I certainly wouldnt be advising you to settle.
