What are we each entitled to in our divorce settlement?

What does the law say about how to split the house, how to share pensions and other assets, and how much maintenance is payable.

What steps can we take to reach a fair agreement?

The four basic steps to reaching an agreement on divorce finances are: disclosure, getting advice, negotiating and implementing a Consent Order.

What is a Consent Order and why do we need one?

A Consent Order is a legally binding document that finalises a divorcing couple's agreement on property, pensions and other assets.

Sorry Highlandlass but I think your petition is seriously flawed. Basically you are saying that any parent that doesn't work who is the PWC should be entitled to Income Support and to keep any amount of Child Maintenace that the NRP pays them each month. The benefit system is there to support people who cannot afford to live (although I do think that it too is seriously flawed but that is another debate)and although I am not entitled to benefits and struggle really badly financially I would not advocate what you are suggesting.

We need to teach our children a good work ethic and although I think a mother should stay at home to care for her child until they start school if at all possible I do think that we should show our children that we should earn our money. Don't get me wrong, I think us stay at home mums earn every penny of Child Tax Credit etc. that we receive but there are some PWC that get little or no CM from their ex-partner. Like most things the benefits system is not a bottomless pot of money and therefore needs to be apportioned to the most needy (although not sure that always happens in reality).

Regards, Sarah

thanks for your response to my posting. Firstly, i never said it was my petion!

I would love to be able to work, but have a medical condition that prevents me from doing so. I have worked right up until I became ill 4 years ago. IUnfortunatly as my symptoms have got worse over the past 12 months, it seems that returning to work will not be an option for the forseeable future.

You are right, yes we do need to instill a good work ethic in our children, and I have done so with mine.

Please do not make the mistake that parents who do not work are all spongers and choose not to work, but to live off the state. that is simply not the case. I only started claiming income support when my husband left me on Boxing Day.

I hope you understand my situation a little better now.
