What are we each entitled to in our divorce settlement?

What does the law say about how to split the house, how to share pensions and other assets, and how much maintenance is payable.

What steps can we take to reach a fair agreement?

The four basic steps to reaching an agreement on divorce finances are: disclosure, getting advice, negotiating and implementing a Consent Order.

What is a Consent Order and why do we need one?

A Consent Order is a legally binding document that finalises a divorcing couple's agreement on property, pensions and other assets.

Does your income support come down when you receive child maintenance from your other half? I was down the Job Centre today to sort out Council Tax benefit and IS. And although they're aware that I'll be getting maintenance payments I wasn't asked how much. I was told now to wait 10 working days before I hear back about the IS.

Normally it is taken into account as income, so will affect how much Income Support you are entitled to. However, the first £20 per week of CM is disregarded.

I can't think why they didn't ask me then. Strange. Perhaps I need to put in in the letter they'll be sending out.

Just been told on a single parenting site that of 1st April this year that child maintenance is disregarded in IS claims. Anyone familiar with this?

I didn't know about these changes. I applied late last year and was told my CM took me over the threshold and I wasn't entitled to IS. Let me know how you get on, I wonder if it'd be worth reapplying.
