What are we each entitled to in our divorce settlement?

What does the law say about how to split the house, how to share pensions and other assets, and how much maintenance is payable.

What steps can we take to reach a fair agreement?

The four basic steps to reaching an agreement on divorce finances are: disclosure, getting advice, negotiating and implementing a Consent Order.

What is a Consent Order and why do we need one?

A Consent Order is a legally binding document that finalises a divorcing couple's agreement on property, pensions and other assets.

I know that, from 12 April 2010, child maintenance does not affect my claim, or the amount I receive, of Income Support.

What about Spousal Maintenance?

I have put a call into the Income Support helpline but they didn't even know and are going to have to call me back.

If it affects the claim, does anyone know how much is disregarded?

I would have thought so as SM is counted as income.
Not a comfort to know that the source is unsure tho!

I have now spoken to CTC and IS and Spousal Maintenance is NOT taken into account and does not need to be declared when applying for benefits.
