I am filing for divorce on the ground of my husbands adultery. Once he realises this he will cut off all financial support and I will have nothing until I can find a job. We are still at the moment living in the same house, albeit in separate rooms. Can I claim any benefits until I find a job.

Hard for anyone to say without knowing more details.

Do you have children? Why are you out of work? Have you paid NI to qualify for JSA etc.

I struggled to claim whilst my ex and I lived together I was instructed to apply by mediation service and she was stunned that my claimwss declined. I was not until my ex left I qualified.

Each case is different if you have no income make an application it''s important you ask why your application has been declined but I have seen others in here who have managed to get benefits while still living with there STBX. Good luck

I claimed tax credits while we were in the same house going through the divorce. At one point they suspended the payments but I appealed and my payments were reinstated. With regards to claiming JSA or Income support its not just a case of having separate bedrooms but demonstrating you live your day to day life separately ie finances, shopping, socialising etc. I work for DWP on the section where cases like this get referred forward home visit

Well done bulldog and thank you for clarifying that each case is individual but please ensure you seperate ever thin to prove your case I somehow managed to fail but it came right in the end ...eventually

And a lot depends on the decision maker on that case. In my own circumstances, everything was established as if my now ex husband didn''t actually live there. My wages and benefits were paid into my sole account and all I paid all the bills including the mortgage. I took holidays without him, socialised without him. In fact the only reminder i had of him being there was his actual presence. When we were divorced and he left i didn''t have to mess about changing direct debit etc as I was actually set up as if he didn''t live there anyway.
I moved back into the big bedroom from the box room, bought new bedding and sleep like a star fish every night :-):-)
