What does the law say about how to split the house, how to share pensions and other assets, and how much maintenance is payable.

What steps can we take to reach a fair agreement?

The four basic steps to reaching an agreement on divorce finances are: disclosure, getting advice, negotiating and implementing a Consent Order.

What is a Consent Order and why do we need one?

A Consent Order is a legally binding document that finalises a divorcing couple's agreement on property, pensions and other assets.

I''ve been claiming tax credits, however I''m now being told I have to prove he doesn''t live here. As apparently we''re financially linked to each other.
I''ve sent all my household bills, plus bank statements. He won''t consent to removing my name from the joint account even though I don''t use it.

I had this and sent them my council tax bill which was by then just in my name with the discount and copies of solicitors letters showing that we were in the process of divorcing. Didn''t take them long to come back to me and confirm that all was in order.

You can also send bank statements of the bank account you currently use showing it is in your name only.

If you do not use the current account you can phone your bank and advise you are separated - they can freeze the joint account which will force his hand. At the very least make sure there is no overdraft facility on there - if he makes that account overdrawn you could be jointly liable for it

I''ve sent, my bank statements joint account statements. All copies of household bills, plus car and home insurance. I''m worried they''ll stop my money, I''m a full time student which will affect my student loan too.

My daughter has applied for a bursary and the higher rate student loan - we are in Scotland so I am not sure if the bursary scheme would apply to you - it may be worth looking into it.
