What are we each entitled to in our divorce settlement?

What does the law say about how to split the house, how to share pensions and other assets, and how much maintenance is payable.

What steps can we take to reach a fair agreement?

The four basic steps to reaching an agreement on divorce finances are: disclosure, getting advice, negotiating and implementing a Consent Order.

What is a Consent Order and why do we need one?

A Consent Order is a legally binding document that finalises a divorcing couple's agreement on property, pensions and other assets.

Can anyone tell me is two divorced parents can claim tax credit for a child each?
Ex is self employed, teaching 7 martial arts classes a week,I work 27 hours in the NHS.
We appear to have finally agreed a shared care arrangement, but it leaves him with two more nights in a fortnight than me.
We have agreed to have child benefit paid into an account soley to be used for school uniform and trips.
I am now concerned that this agreement leaves me unable to claim any benefits, and he can claim for both?

You could each claim CB and tax credits for one child if you want to.

Who is claiming CB?

I think it's currently in my name as I did the forms over 11 years ago, but the money has always been paid into the joint account.

I have always had Child Benefit and looked after our child 95% of the time. But my ex wife was able to get child tax credits. Just waiting to get back how this was assessed from her solicitors as something is just not right here.

Only one household can make a claim for a child.

If there is a dispute over which parent should claim then whoever is claiming CB usually gets awarded it.
