What are we each entitled to in our divorce settlement?

What does the law say about how to split the house, how to share pensions and other assets, and how much maintenance is payable.

What steps can we take to reach a fair agreement?

The four basic steps to reaching an agreement on divorce finances are: disclosure, getting advice, negotiating and implementing a Consent Order.

What is a Consent Order and why do we need one?

A Consent Order is a legally binding document that finalises a divorcing couple's agreement on property, pensions and other assets.

Do you need legal advice on a fair financial settlement?

We offer a consultation with experienced family solicitor for a low fixed fee. You will receive legal advice and a written report outlining your legal position and setting out what a fair settlement would look like based on your individual circumstances.

smalik hi
I accumulated a lot of debt during my marriage and now have to prove the debt was family debt and not pure extravagance!!!
I have started to come to arrangement with creditors for a gesture of payment until my settlement as advised by cccs,my fh in march(provisional date)
I think if debt was personal and you bankrupt the judge would not consider that and still give fair division
I would be interested to see how you go on and how much your debt is , pm me if you dont want to post...but bet mines more!!!!!
Its the biggest issue for the fh as far as my x2b is concerned...as he is taking no responsibility despite he has possesion at the moment of most of stuff bought on credit

The debt i have built up has been the money i have had to borrow to fund my divorce and child contact hearing and also I stopped work due to stress and i am self employed (limited copany ) Has Vat and corporation tax liabilities etc, If these are not paid the company will be made bankrupt.

I have made many offer to get my x2b to settle but she is demanding more money than that is available from the assets available. I dont understand how her sol can expect me to provide her money that does not exist in assets. She is on legal aid and i sure the sol is milking the system because x2b is stupid.

Well i suppose if i am made bankrupt then i wont be able to run my nusiness which cqan give me good income.

Then if you can prove that the debt should go in the pot and taken into account
Get supporting evidence also as to your state of wellbeing
I thought about bankruptsy , but the knock on effect is too much, It can ruin alot of your future aspirations
I was actually looking at applying for magistrate and looked at the critera and bankrupt is a no go
Think what im trying to say is that whilst keeping afloat now you need to look ahead and see that your future has a place in your present
think hard and contact the cccs(cant do that posting links stuff but just google cccs and youll get the site (uk)
