What are we each entitled to in our divorce settlement?

What does the law say about how to split the house, how to share pensions and other assets, and how much maintenance is payable.

What steps can we take to reach a fair agreement?

The four basic steps to reaching an agreement on divorce finances are: disclosure, getting advice, negotiating and implementing a Consent Order.

What is a Consent Order and why do we need one?

A Consent Order is a legally binding document that finalises a divorcing couple's agreement on property, pensions and other assets.

Hi everyone :)

I am going through a divorce. As part of the overall debt, my wife''s parents are including all of the money they gave to us during our marriage. I have signed nothing to say this is a loan or a gift (I obviously assumed it was a gift or else I wouldn''t have accepted it) and I wanted to know if I was liable for this?

Any help would be appreciated - thanks

Andrew

Hi Andrew,
Welcome to wiki but sorry you find yourself here.
The usual form with loans from family, particularly if there is no documentation is that they are seen as ''soft-loans'' or gifts and you would not be liable.

Thanks very much for the info.

Do you know of anywhere where I can verify that? I need an extract from a legal document if know of one!

Thanks

I should have mentioned the reason I need this evidence is because I am divorcing in Spain (but under UK law) and need to prove to the courts that this is the case.

thanks
