The four basic steps to reaching an agreement on divorce finances are: disclosure, getting advice, negotiating and implementing a Consent Order.

What is a Consent Order and why do we need one?

A Consent Order is a legally binding document that finalises a divorcing couple's agreement on property, pensions and other assets.

Yes, I''m pretty sure that the car would be classed as a marital asset, and the loan a marital debt.

I had both a loan & a credit card in my name only and used for personal & family items, and all repayments were solely from my account. Both were classed as marital debts - much to my ex''s annoyance...she figured that, as her name wasn''t on any of the paperwork she''d not be stung for half of what still remained, yet in the same breath she was quite happy to try and take half the value of the house which also did not have her name on and towards which she''d never paid a penny. She was soon put right on all matters by her solicitor!
